An apparatus for sorting the waste materials is provided with a sorting device crushing the waste materials consisting of packaging materials and garbage and separating them into the packaging materials and the garbage, a controlling vessel storing the garbage separated in the sorting device in a slurry, a packaging material discharge part discharging the packaging materials separated in the sorting device, and a garbage-stuck packaging material separating and transferring means separating the garbage-stuck packaging materials from the packaging materials discharged from the packaging material discharge part by using the difference in scattering properties and introducing the garbage-stuck packaging materials to the sorting device. A method for sorting the waste materials consisting of the packaging materials and the garbage into the packaging materials and the garbage sorts the waste material into the garbage-free packaging materials and the garbage-stuck packaging materials by using the difference in the scattering properties, and separates the sorted garbage-stuck packaging materials into the garbage and the garbage-free packaging materials.
