Special data is inputted from a terminal 6B so as to unilaterally increase a DSV (digital sum variation) cumulative value when it is encoded together with a standard subcode byte. When this special data is recorded, a special subcode is inputted from aa terminal 7C so as to set the DSV cumulative value in a fixed range when it is encoded as the subcode data of an EFM frame together with the special data. A disk on which a recording signal formed in such a manner is recorded is copied by a CD-R or the like. Since the subcode data is replaced by the standard data during encoding, when the created disk is played by a normal CD player, the DSV cumulative value is increased to possibly impede normal data reproduction, and thus, the copy protection of the disk is realized.
