To provide a toner which effectively prevents offsetting and winding of paper with a small amount of a release agent and retains excellent fixability and stability of a charged state over a prolonged period of time and to provide an image forming apparatus which causes neither offsetting nor winding of paper even when an oilless fixing unit is used.

A polyester resin having 20-50 mg/KOH hydroxyl value is used as a bonding resin, a vegetable wax and an alcohol modified synthetic hydrocarbon wax having 20-60 mg/KOH hydroxyl value are used as a release agent and the vegetable wax content of the release agent is adjusted to 20-40 wt.%. In order to improve dispersion of these waxes in the polyester resin, preferably the waxes are previously mixed, vitrified and used.
