To provide an image processing whereby a designated particular image part is not overlapped with a frame in a still picture such as a photographed image.

An image processing apparatus for overlapping a frame image acting like a frame for decorating a still picture with the still picture of a prescribed size designates an image part in a particular color in the still picture and discriminates the frame part of the frame image. Then the image processing apparatus detects an overlapped state between the designated image part in the particular color and the discriminated frame part together with a positional relation between the still picture and the frame image. Consequently the image processing apparatus decides the overlapped position of the frame image with respect to the position of the still picture to a position at which the overlapping between the image part in the particular color and the frame part is small.
