To provide a network relay device which can suppress degradation of throughput at the time of congestion detection, and a packet transfer control method.
A network relay device includes: a congestion notification section 3 for determining a mark rate so that the mark rate may increase in proportion to a buffer quantity from 0% of the mark rate to the maximum mark rate when the buffer quantity of a port or a queue which has detected the congestion is more than the mark starting quantity and less than the maximum buffer quantity; and a mark rate adjustment section 4 for increasing the maximum mark rate when a packet loss occurs in the port or the queue which has detected the congestion or when the buffer quantity of the port or the queue which has detected the congestion exceeds the predetermined upper limit threshold value, and decreasing the maximum mark rate when no packet loss occurs in the port or the queue which has detected the congestion or when the buffer quantity of the port or the queue which has detected the congestion is below the upper limit threshold value.
