A photo-interrupter (sensor) SN1 is provided on a clincher part 5b and a detection plate 500 is provided in a range in which a connection guide part 28a and operation of the stapler 5 are not interfered. A non-operation area d of the stapler 5 can be detected and motion of the staple is forbidden upon detection of the sensor SN1. Further, the detection range of the sensor SN1 requires a non-interfering area (non-operation area d) even if at least staple binding is carried out relative to the connection guide part 28a and the detection position is made to a position taking a room of +α relative to the non-operation area (d).
