To enable moving reliably a staple to the vicinity of the upper surface of a paper sheet bundle to improve the binding precision of the staple.
A binding device binds a paper sheet bundle by inserting right and left leg parts of a staple into right and left binding holes formed in the paper sheet bundle and folding the leg parts and comprises: a staple holding member provided with right and left side walls; and a staple push-down member arranged between the side walls of the staple holding member. The staple holding member holds the staple between the right and left walls by undergoing external and downward engagement in the staple by the right and left side walls to cause elastic deformation of the right and left leg parts in such a way as to extend vertically and downward from a crown part and moves downward, while holding the staple, so that its lower end comes in contact with the upper surface of the paper sheet bundle. After the staple holding member holding the staple comes in contact with the upper surface of the paper sheet bundle, the staple push-down member moves downward with respect to the staple holding member to insert the leg parts of the staple into the binding holes.
