To provide a recording and reproducing apparatus and a recording and reproducing method capable of designating a user to which reproduction of recorded program contents is permitted in the case of reserving recording of the program contents.

The recording and reproducing apparatus comprises: a priority information management means for managing from which terminal of reservation recording settings of program contents are to be prioritized among a plurality of mobile information terminals; a means for managing reservation recording setting information of the program contents from a prescribed terminal on the basis of the priority information; setting means (S220 to S280) whereby the prescribed terminal carries out reservation settings of recording of the program contents to set a user to which the browsing of the program contents made for recording reservation is permitted; a contents recording means for recording the program contents on the basis of the reservation recording setting information; and a reproduction means for reproducing the recorded program contents on the basis of the setting means.
