Problem with Carrying Skateboards

[0035] Skateboards and skateboarding is a very popular sport and widely enjoyed by younger people for getting around town or a campus. However, carrying a skateboard in a person's hands or arms is inconvenient.

Skateboards

[0036] Various skateboard designs are well known in the art of skateboards. A few basic elements are briefly described here merely to provide relevant context for the problem and a device or method according to the invention, briefly referring ahead to Figures 5, 6, and 8.

[0037] Referring to Figure 5, a conventional skateboard 700 includes a deck 710 and two trucks 730 for the wheels (only right wheels 780 visible in this view), where one truck 730 is positioned toward each end of the deck.

[0038] Decks can vary in size, but for skateboards are usually in the range of about 7 to about 10.5 inches (18 to 27 centimeters) wide. Skateboard decks are usually between about 28 and about 33 centimeters (71 and 84 cm) long. A longboard is a skateboard having a longer deck. For longboards, decks are usually over 36 inches (91 cm) long.

[0039] Typically, each end of the deck 710 is slightly angled, as illustrated in Figure 5.

[0040] Grip tape (not shown in the Figures) is typically applied to the top of the deck to allow the rider's feet to grip the surface and help the skater stay on the board while doing tricks. Grip tape is a sheet of paper or fabric with adhesive on one side and a surface similar to fine sand paper on the other.

[0041] Referring to Figure 6, each truck 730 has two main parts, that is, a baseplate 740 and a hanger 750. The baseplate 740 is screwed to the underside 720 of the deck 710. The baseplate 740 connects the hanger 750 to the deck.

[0042] The hanger 750 has a neck portion 755 that widens out to the body of the hanger 750 as structural support for an axle 760 running through the left and right legs of the hanger 750. The hanger 750 supports the axle 760 perpendicularly to the length of the deck 710.

[0043] A left wheel 770 and a right wheel 780 are connected to each end of the axle 760. Each wheel is mounted on its axle using bearings (not shown). Each bearing usually contains seven steel or ceramic ball bearings, although other configurations are used. The wheels of a skateboard come in many different sizes and shapes. Larger diameters (55-85 millimeters) roll faster. Smaller diameters (48-54 millimeters) roll slower. Larger wheels are used in longboarding and downhill skateboarding. Sizes typically range from 65 millimeters to 100 millimeters.

[0044] Referring ahead to Figure 8, each truck 730 has a kingpin 790, which is a relatively large bolt. The kingpin 790 run through bushings (not shown) and connects the hanger 750 to the baseplate 740. As will be known by those knowledgeable of skateboards, the position of the hanger 750 with respect to the baseplate 740 is also determined by a pivot (not shown), which is a rod that slots into a corresponding seat (not shown) in the baseplate 740. The pivot stops the hanger from rotating around the kingpin 790. The pivot must allow some movement around the bushings. The bushings around the kingpin 790 provide a cushion mechanism during the angling of the hanger 750 relative to the baseplate 740, which allows for turning the skateboard. [0045] Trucks that are specific for longboards typically have a "reverse" kingpin arrangement (not shown), where the kingpin is in a reverse orientation.

[0046] In addition, an electric skateboard is a skateboard that includes an electric motor. The electric motor is connected to one of the wheels and a battery pack is mounted to the underside of the deck between the trucks, where the batter pack is electrically connected to the electric motor. Electric skateboards have the same or similar trucks as conventional skateboards. Because the battery pack adds weight, it would be even more desirable to be able to carry an electric skateboard more conveniently.

[0055] Referring now to the drawing, Figure 1 is a perspective view looking at the front of a hook device 100 according to an embodiment of the invention. The hook device 100 includes a base part 200, which is formed of a strong structural material such as metal.

[0056] In this embodiment, the base part 200 includes a body portion 210 and a left hook portion 230 and a right hook portion 240 having a slot 245 between the left and right hook portions.

[0057] In this example embodiment, the base part 200 is formed of a sheet metal having a thickness of about 3 millimeters. The base part 200 has an overall width of about 126 millimeters. The overall base part 200 has an overall height of about 80 millimeters. The base part 200 has an overall depth (regarding the hook portions 230 ad 240) of about 40 millimeters.

[0058] In this embodiment, the body portion 210 is a flat web of sheet metal. [0059] As will be described in more detail, the left hook portion 230 and the right hook portion 240 are adapted to support the hanger of a truck of a skateboard (not shown in this Figure). The slot 245 provides a space for the neck portion of the hanger that would otherwise interfere with positioning the hanger of the truck to engage the hook portions 230 and 240 of the hook device 100.

[0060] As will be described in more detail, device straps 300, including left device strap 310 and right device strap 320, can be secured to the base part 200. Device straps 310 and 320 have a threading end 312 and 322, respectively, and a snap end 314 and 324, respectively. The threading end of each of the device straps 300 can be threaded through a pair of slots 250 or 260 in the body portion 210 of the base part 200. The threading of the threading ends 312 and 322 of the device straps, 310 and 320, respectively, through the pairs of slots 250 and 260, respectively, securely attaches each of the straps, respectively, to the body portion 210 of the base part 200 through a frictional engagement.

[0061] As will be described in more detail, the other end of each device strap 300 can be connected to the body portion 210 of the base part 200 with a releasable snap 400. Each snap 400 includes a female part 410 and a male part 420. The female part 410 includes a female base 412, a female snap portion 414 (not shown in this Figure), and screws 416 for securing the female base 412 to the body portion 210 of the base part 200. The male part 420 includes a base grommet 422 and a male snap portion 424 adapted to snap into the corresponding female snap portion 414, and a male screw cap 426. The base grommet 422 goes through a hole in the snap end of a device strap and the male screw cap 426 screws into the base grommet 422 to secure the male part 420 of the snap 400 onto the snap end of the device strap.

[0062] As will be described in more detail, each device strap 310 and 320 can be looped around a shoulder strap of a backpack and snapped in place on the base part 200 to secure the base part to the strap (not shown in this Figure) of a backpack.

[0063] As will be described in more detail, an optional aperture 290 in the body portion 210 of base part 200 can be used for optionally hanging the hook device 100, for example, on a separate wall hanger (not shown in this Figure).

[0064] In addition, the hook portions 230 and 240 preferably have pads 500, which are formed of a resilient material such as rubber. The pads 500 can be held in place on the hook portions 230 and 240 with a suitable adhesive (not shown). The pads can help absorb any small shocks from the hanger of the truck of a skateboard while using the device to carry a skateboard. In addition, the pads 500 help protect against metal-to-metal wear between the hook portions of the hook device and the hanger of a truck of a skateboard.

[0065] Figure 2 is a perspective view looking upward toward the front of the hook device 100 illustrated in Figure 1, where the right device strap 320 is shown in a loose, unsnapped position. Figure 2 is similar to Figure 1, where a female snap portion 414, a base grommet 422, and a male snap portion 424 are visible.

[0066] Figure 3 is a perspective view looking at the front of the hook device 100 illustrated in Figure 1 in a position similar to that of Figure 2, partially attached to a backpack 600. The backpack 600 has a frameless pack body 610 with a zipper 620 for opening and closing the pack body. A backpack has a left shoulder strap 650 and a right shoulder strap 660. A shoulder strap can be used to sling the backpack over one shoulder of a person (not shown) or both the left and right shoulder straps 650 and 660 can be used to suspend the pack body 610 from the shoulders of a person and against the person's back (as illustrated in Figure 5). As illustrated in Figure 3, the hook device 100 is shown after the left device strap 310 has been looped and secured around the left strap 650 of a backpack 600 and showing the right device strap 320 in the process of being looped around the right strap 660 of the backpack 600 and then to be secured by snapping into place.

[0067] Figure 4 is a perspective view looking at the front of the hook device 100 illustrated in Figure 1 in a position on a backpack similar to that shown in Figure 3, but after the left device strap 310 has been looped and secured around the left strap 650 of a backpack 600 and after the right device strap 320 has been looped around the right strap 660 of the backpack 600 and snapped into place.

[0068] Accordingly ,the device straps 300 of the device can be positioned around the shoulder straps of a backpack. The device straps can be positioned at about 45 degrees angle to the base part 200 as this is the angle at which they are naturally positioned when in place on a backpack. The device straps can be made of any suitable strong, flexible material for such purpose, such as of leather, plastic, or nylon. The device straps can be of any convenient length and cross section. For example, they need not be flat in cross section, but can be round, if desired.

[0069] In various embodiments, the two device straps 310 and 320 that can fit around the two shoulder straps 650 and 660 of the backpack 600 are made of a flexible material such as webbed nylon and the snaps 400 can be the previously patented FIDLOCK brand snap attachment, which is a German company. Preferably, the snaps 400 are magnetic. This allows for quick and easy location of the straps when attaching the hook device to a backpack, and which can be very helpful in dim lighting.

[0070] The device straps 300 can be secured or tightened according to various techniques. For example, a hook device 100 according to the invention can be designed with convenient snap connectors, such as FIDLOCK brand snap connectors, as illustrated in Figures 1-4.

[0071] Figure 5 is a side view of the right side of a person 800 walking and carrying a backpack 600 on the person's back 810 and supported over the person's shoulders, where the person's right shoulder 820 is visible. The hook device 100 is secured to the backpack 600 as illustrated in Figure 4. Figure 5 additionally shows a skateboard 700 hanging from the hook device 100 by one of the trucks 730 of the skateboard 700.

[0072] A skateboard 700 can be hung on the backpack 600 with the trucks 730 facing toward the back 810 of the person 800 and the upper side of the deck 710 facing toward the rear of the user.

[0073] Continuing to refer to Figure 5, the hook device enables a person 800 to attach a skateboard 700 onto a backpack 600. The hook device 100 can be used to attach around each of the two straps of a backpack where they meet the top of the backpack behind the user's shoulders. It is also possible to use the hook device 100 attached to only one of the shoulder straps 650 or 660 of the backpack, however, that may not keep a skateboard hanging centered over the backpack. The device straps 300 can be passed around the outside of the straps and back down through the center or in reverse.

[0074] The hook device 100 preferably sits adjacent the top of the backpack 600 and allows for a skateboard 700 to be hung from the backpack as illustrated in Figure 5. Positioning the hook device 100 near the top of the backpack 600 helps prevent a skateboard, especially a longboard, from hanging lower, which might interfere with a person's walking.

[0075] The flat design of the body portion 210 of the hook device 100 of the preferred embodiment means that it is sits against the pack body 610 and toward the top of the backpack 600. The underside of the skateboard 700 is oriented to face the backpack with the top of the deck (usually having grip tape) facing backwards relative to the direction of the walking of the person carrying the backpack.

[0076] The angled shapes of the hook portions 230 and 240 provide that there be little movement when the truck of a skateboard is sat in place as the person walks.

[0077] Figure 6 is a closer perspective view similar to Figure 5 showing the backpack 600 (is it may be suspended over the shoulders of a person, not shown in this Figure), wherein a hook device 100 is secured to the backpack 600 as illustrated in Figure 4, additionally showing the hanger 750 of a truck 730 of the skateboard 700 in the process of being hung on or removed from the hook portions 230 and 240 of the hook device 100.

[0078] Figure 7 is closer perspective view similar to Figure 6 showing the hanger 750 of a truck 730 of the skateboard 700 engaged with and hung on the hook portions 230 and 240 of the hook device 100.

[0079] Figure 8 is another closer perspective view similar to Figure 7, but from the behind, showing the hanger 750 of a truck 730 of the skateboard 700 engaged with and hung on the hook portions 230 and 240 of the hook device 100. Some of the details of the skateboard 700 were described above with respect to this Figure of the drawing. In addition, this Figure shows the threading ends 312 and 322 of the device straps 310 and 320, respectively, as they can be threaded through the pairs of slots 250 and 260, respectively. The pairs of screw holes 270 and 280 shown in Figure 8 are not visible in Figures 1 through 7, but the pars of screw holes 270 and 280 are used for the screws 416 to secure the female base 412 of each snap 400 to the body portion 210 of the base part 200.

[0080] In various embodiments, the base part 200 of the hook device 100 is made from a single piece of sheet material 202, preferably of aluminium. The base part 200 can be formed from a shaped and cut piece of sheet metal such as sheet material 202. Figure 9 is a front or back elevation view (symmetrical in the plane of the illustration) showing a flat piece of sheet material 202 in a stage of manufacturing of the base part 200 (not shown in this Figure), wherein the pairs of slots 250 and 260, the pairs of screw holes 270 and 280, and the aperture 290 have already been formed in the sheet material 202, but before the forming of the lower left and right wing portions 232 and 242, respectively, of the sheet material 202 into the hook portions 230 and 240, respectively, of the base part 200 shown in Figure 1. In this embodiment, the flat piece of sheet material 202 has an overall width of about 126 millimeters and an overall height of about 126 millimeters.

[0081] Figure 10 is a side elevation view of the flat piece of sheet material 202 illustrated in Figure 9, showing the relatively small thickness of the flat piece of sheet material 202.

[0082] Figure 11 is a front elevation view of the base part 200 of the hook device 100 illustrated in Figure 1, where in this view the hook portions appear to curve upward, above the body portion 210 of the base part 200.

[0083] The slot 245 between the hook portions 230 and 240 widens toward the front of the base part 200. The widening portion of the slot 245 is adapted to help accommodate the shape of a hanger 750 of a truck 730, as illustrated in Figures 6-7. The narrow portion of the slot 245 can accommodate any protrusion of the kingpin 790, as illustrated in Figure 8. In this embodiment, the narrow portion of the slot 245 is about 10 millimeters wide.

[0084] Continuing to refer to Figure 11, in this embodiment, each of the pair of slots 250 and each of the pair of slots 260 is about 4 millimeters wide and about 24 millimeters long. These dimensions of the pairs of slots 250 and 260 are adapted to accommodate the passage of the threading ends 312 and 322 of the device straps 310 and 320, respectively, as illustrated in Figures 1, 2, 4, 6, 7, and 8. In various embodiments, various sizes or shapes of device straps 300 could be used and that the sizes of the pairs of slots 240 and 260 could be adjusted accordingly.

[0085] Continuing to refer to Figure 11, the angle of the pairs of slots 250 and 260 is about 45 degrees from the horizontal or vertical, where the pair of slots 250 are angled downward from a center of the base portion 210 and where the pair of slots 260 are where the pair of slots 250 are angled downward from a center of the base portion 210. These angles of the pairs of slots 250 and 260 helps position the straps 310 and 320 (not shown in this Figure) for attachment to the left and right shoulder straps of a backpack (not shown in this Figure), as illustrated in Figure 4 and Figures 6 and 7. In various embodiments, various sizes or shapes of the device straps 300 could be used and that the angles of the pairs of slots 240 and 260 could be adjusted accordingly.

[0086] Continuing to refer to Figure 11, the positions of the pairs of screw holes 270 and 280 are adapted to meet the positions of the pairs of screws 416 (not shown in this figure) for attaching the base female parts 412 of the snaps 400 (as illustrated in Figures 2-3). In various embodiments, the designs for the snaps 400 could be used and that the number, sizes, and positions of the screw holes 270 and 280 could be adjusted accordingly.

[0087] Continuing to refer to Figure 11, the aperture 290 is illustrated, as will be described regarding Figures 20 and 21.

[0088] Figure 12 is a side elevation view of the base part 200 shown in Figure 11, showing a hook portion at a side end away from the slot having a diameter of curvature of about 20 millimeters.

[0089] Figure 13 is a bottom elevation view of the base part 200 illustrated in Figure 11, where in this view the hook portions 230 and 240 appear to curve upward, in front of the body portion 210 of the base part 200.

[0090] Figure 14 is a cross-sectional view of the base part 200 taken along section A-A of Figure 13, showing the partial cone curvature of the hook portion 230, wherein the diameter of curvature adjacent the slot 245 is about 30 millimeters. The shape of hook portion is a symmetrical reflection of a perpendicular plane through section A-A regarding hook portion 240 (not shown).

[0091] Figure 15 is a rear elevation view of the base part 200 illustrated in Figure 11, where in this view the hook portions 230 and 240 appear to curve upward, but behind the body portion 210 of the base part 200. In this embodiment, the angle of slope at the bottom of each of the hook portions 230 and 240 is about 11 degrees from the horizontal, each upward from the widest portion adjacent the slot 245.

[0092] As can be seen from Figures 11 through 15, the shape of each hook portion 230 and 240 includes a semi-conical portion (i.e., not entirely circumferential of the hook portions 230 and 240, but where the upper section of each of the hook portions is open for receiving a hanger 750 of a truck), where the widest portion of the conical portion is about 30 millimeters and the narrowest portion is about 20 millimeters. The widest portion is adjacent the slot 245, whereas the narrowest portion is toward the sides of the base part 200.

[0093] The shape of each hook portion 230 and 240 with the slot 245 between them is adapted to receive the shape of a typical hanger 750 of a truck 730 of a skateboard, allowing for the left wheel 770 and the right wheel 780 to extend outside the hook portions 230 and 240, respectively, as illustrated in Figures 7 and 8.

[0094] In a preferred embodiment, an element of the hook device 100 is the central slot 245 between the two hooks portions. The slot 245 has a profile that widens to form a profile in the general shape of a valley between the hook portions 230 and 240. This widened section sits snugly against hanger 750 of the skateboard. Each of the hook portions 230 ad 240 widens out toward the wheels 770 and 780 on the truck 730. The hook portions 230 ad 240 help support the truck in place.

[0095] A hook device 100 according to the invention can be designed to hook either or both of traditional and reverse kingpin trucks of skateboards. A skateboard 700 can be hung from the hook device 100, where the hook device 100 fits under one of the trucks 730 of the skateboard to hang and hold the skateboard in place. The hook device 100 can be designed with conventional or with reverse kingpin trucks of skateboards. It can be used on trucks that have either a traditional kingpin 790 or a reverse kingpin (not shown).

[0096] Figure 16 is another perspective view from an upper, right side of the base part 200 illustrated in Figure 11, but looking downward, toward the right side of the base part 200.

[0097] Figure 17 is another perspective view from an upper, left side perspective of the base part 200 illustrated in Figure 11, but looking downward, toward the left side of the base part 200.

[0098] Figure 18 is another perspective view from an upper, right side perspective of the base part 200 illustrated in Figure 11, but looking downward, toward the right side of the base part 200.

[0099] The base part 200 is preferably powder coated. The powder coating can be in any desired colour.

[0100] Figure 19 is an enlarged planar view of suitable shapes for resilient pads 500, specifically pads 510 and 520, for the hook device 100 illustrated in Figure 1. In this embodiment, the left and right pads 510 and 520 are generally wing shaped and adapted for the left and right hook portions 230 and 240, respectively, as shown in Figures 1 and 6. The hook portions 230 and 240 preferably have pads 500, which are formed of a resilient material such as rubber, which helps absorb any small shocks from the truck of a skateboard while using the hook device 100. The pads can be held in place with a suitable adhesive. In an alternative embodiment, for example, the pads can be formed to fit in the hook portions 230 and 240 as tight- fitting, non-slipping sleeves that are open toward the top (not shown in the Figures).

[0101] Figure 20 is front perspective view of a hook device 100 shown hanging on a wall hanger 900. The wall hanger 900 can be mounted on a wall, such as the wall 910 of a home or classroom. The wall 910, however, is not part of the wall hanger 900. The wall hanger 900 includes a base 920 that can be mounted to the wall 910 with a top screw 930 and a bottom screw 940 through suitable holes (not visible in this figure) in the wall hanger base 920. The top and bottom screws 930 and 940, respectively, can be, for example wood screws for engaging wooden studs (not shown) or of the wall 910 or molly bolts for engaging sheetrock of the wall 910. The shape of the base 920 and the number and configuration of the screws 930 and 940 can be varied to any convenient and suitable design. The wall hanger 900 also a post 950 that extends, for example, horizontally, from the base 920. The post 950 can include a groove 960 that is adapted to help retain the hook device 100 on the post 950. For example, the groove 960 can be circumferential of the post, about 4 millimeters in width along the post 950 to accommodate the thickness of the base portion 210 of the base part 200, and about 1 to about 3 millimeters deep.

[0102] Figure 21 is a perspective view of the wall hanger 900 illustrated in Figure 20, shown mounted on the wall 910 (without a hook device 100 hanging from the wall hanger).

[0103] In various embodiments, a hook device, such as hook device 100, can be provided as a package with a wall hanger, such as wall hanger 900.

Principles of Interpretation

[0106] The words, phrases, and other symbols used herein have their plain, ordinary meaning to persons of skill in the art of this disclosure, except to the extent explicitly and clearly defined in this disclosure, on the condition that even if explicitly defined in this disclosure, the specific context may still require a different or more specific meaning. The definitions provided are intended to clarify— not confuse; all possible relevant senses of the multitude of words may not be accounted for in the specific definitions.

[0107] Initially, as a general aid to interpretation, the possible definitions of the words, phrases, and other symbols used herein are intended to be interpreted by reference to comprehensive general dictionaries of the English language published before or about the time of the earliest filing of this application for patent. A preferred dictionary is the American Heritage Dictionary of the English Language, 5 th Edition (Houghton Mifflin Harcourt, 2016). Where several different general definitions are available, it is intended that the broadest definitions or senses be selected that are consistent with this disclosure and the description of the presently most-preferred embodiments, including without limitation as shown in a Figure of any drawing.

[0108] After initially consulting such general dictionaries of the English language, it is intended that the words, phrases, or other symbols used herein be further interpreted or the most appropriate general definition or definitions be further selected by consulting technical dictionaries, encyclopedias, treatises, or relevant prior art to which the claimed invention pertains. If necessary to resolve any remaining doubt, utilizing the patent prosecution record may be helpful to select from among the possible interpretations.

[0109] Terms or phrases made up of more than one word (e.g., compound terms or phrases or names) are sometimes not found in general dictionaries of the English language. Compound terms or names are to be interpreted as a whole, and not by parsing the separate words of the compound term, which might result in absurd and unintended interpretations. For example, in the context of railroad technology, a "coal car" does not mean a car made of coal, but is well understood to mean that the railroad car is for hauling coal. In general, compound terms are to be interpreted as they would be understood in the art and consistent with the usage in this specification.

[0110] It is intended that examining relevant general dictionaries, encyclopedias, treatises, prior art, and the patent record will make it possible to ascertain the appropriate meanings that would be attributed to the words and terms of the description and claims by those skilled in the art, and the intended full breadth of the words and terms will be more accurately determined. In addition, the improper importation of unintended limitations from the written description into the claims will be more easily avoided.

[0111] If there is any conflict in the usages of a word or term in this disclosure and one or more patent(s) or other documents that are incorporated by reference, the definitions that are consistent with the original material of this disclosure should be adopted in interpreting the original material of this disclosure and the definitions that are consistent with the document incorporated by reference should be adopted in interpreting the material from that document.

[0112] Many words have multiple different senses. The selection of the applicable sense is usually understood from the particular context in which the word is used. If a word is specifically defined herein in a particular sense that does not reasonably apply in the context of a particular instance of usage elsewhere in the disclosure or claims, an applicable sense definition should be applied, not an inapplicable definition for a different context of usage. If any explicit definition herein is plainly obnoxious both to every ordinary meaning and to every technical meaning in the art for a usage in a particular context, the explicit definition herein should be disregarded as an obvious and unintended error.

[0113] The headings and subheadings used in herein are intended for convenient reference but are not intended to be limiting.

Patent Terminology

[0114] A patent "claim" (noun) means either (a) a statement of the subject matter for which legal protection is sought in an application for patent or (b) a statement of the subject matter for which legal protection has been granted (that is, legally recognized) in an issued patent. (A patent claim is distinguishable from other types of legal claims and distinguishable from non-legal claims, such as factual or medical claims.) [0115] "Disclosure" (noun) (of an application for patent) means the specification of the written description with any original claims and any drawings, as of the effective filing date of the subject matter of a claim. The purpose of the disclosure is to disclose, that is, to make known.

[0116] An "original" claim of a patent is a claim that is filed at the time of filing an application. An original claim is also part of the original disclosure. For the purposes of disclosure, an original claim can be treated as disclosure; however, for the purposes of examination of patentability and interpretation of full scope of an issued patent, any claim should be interpreted as broadly as literally stated except for any obvious error or except as may be interpreted under the doctrine of equivalents.

[0117] For the purposes of disclosure, all variations, combinations, and permutations in which one or more limitations, elements, clauses, and descriptive terms from one or more of the original claims is introduced into another original claim is part of the disclosure. For example, any original claim that is dependent on another original claim can be amended to include one or more limitations found in any other original claim that is dependent on the same original base claim.

Transitional Terminology

[0118] The words "comprising," "containing," "including," "having," "characterized by" and all grammatical variations thereof are intended to have an open, non- limiting meaning as to any unstated limitations.

[0119] In a claim, the transitional term "comprising," is inclusive or open-ended and does not exclude additional, un-recited elements or method steps. "Comprising" in claim language means that the specified elements are essential, but other elements can be added and still form a construct within the scope of the claim. For example, a composition comprising an ingredient does not exclude it from having additional ingredients, an apparatus comprising a part does not exclude it from having additional parts, and a method having a step does not exclude it having additional steps.

[0120] In a claim, the transitional phrase "consisting essentially of" and all grammatical variations thereof are intended to limit the scope of a claim to the specified materials or steps and those that do not materially affect the basic and novel characteristic(s) of the claimed invention. A "consisting essentially of claim occupies a middle ground between fully open claims using a "comprising" format and closed claims that are written in a "consisting of format.

[0121] In a claim, the transitional phrase "consisting of excludes any element, step, or ingredient not specified in the claim. For example, "consisting of is defined as closing the claim to the inclusion of materials other than those recited except for impurities ordinarily associated therewith. For another example, a claim for a bone repair kit "consisting of" certain chemicals in a claim was infringed by a bone repair kit including a spatula in addition to the claimed chemicals because the presence of the spatula was unrelated to the subject matter of the claimed invention.

[0122] For the purposes of disclosure, however, such transitional phrases additionally subsume and include a disclosure of any more limited meanings. For example, a disclosure using the word "comprising" or like open-ended terms herein is intended to support a claim using any of the transitional terms "comprising," "consisting essentially of," or "consisting of." Similarly, a disclosure using the phrase "consisting essentially of is intended to support a claim using the narrower phrase "consisting of."

Other Grammar

[0123] The indefinite articles "a" or "an" mean at least one of the noun or noun phrase that the article introduces.

[0124] For the purposes of disclosure, where elements are presented as groups or lists, e.g., in "Markush group" format, each and every possible subgrouping of the grouped or listed elements is also disclosed as if set forth in separate lists. For example, where a disclosed group of three elements is disclosed, any subgrouping of one or two of the three elements is disclosed. For the purposes of disclosure, in various embodiments exactly one member of a group is present in, employed in or otherwise relevant to a given product or process. In various embodiments one, more than one, or all of a group members are present in, employed in, or otherwise relevant to a given product or process. [0125] The phrase "one or more" of something means an alternative grouping of the something. For example, "one or more alcohols" means any one specific species of alcohol or any grouping of two or more different specific species of alcohols.
