A hydraulic drive device allowing effective use of return oil with driving speed of a hydraulic actuator maintained, and a working machine having the hydraulic drive device. The hydraulic drive device has a controller (15). While external force under which the pressure (P2) of return oil exceeds the discharge pressure (P1) of the hydraulic pump (17) is applied, the controller (15) specifies a recovery flow rate and a surplus flow rate based on power required by a hydraulic pump (17). The recovery flow rate is a flow rate of return oil, not including return oil led to a tank (B1) via a control valve (24), which can be led to a recovery oil path (28). The surplus flow rate is the flow rate other than the recovery flow rate. Upon specifying the flow rates, the controller leads the return oil of the recovery flow rate to the recovery oil path (28) and controls an MO valve (21) and a regulator (23) so that the return oil of the surplus flow rate is led to a lead out flow path (20).
