Best Mode for Carrying Out the Invention

[42] Below, with the attached figures as a reference, the correct operation of the method of trading digital rights management based digital contents of this invention is explained in detail.

[43]

[44] Figure 1 is an organization chart of the operation of the method of trading digital rights management based digital contents.

[45] First, before explaining the method of trading digital rights management based digital contents, the technology of digital rights management (DRM) must be understood.

[46] As a technology devised to protect the intellectual property rights of digital contents, though the forms of this technology can vary, the basic concept is that the special information of digital contents can be read and written for the purpose of when the digital content is circulated through wire or wireless internet, that information can be traced and managed.

[47] Therefore, copying or lending digital content at will can be originally seen as impossible.

[48]

[49] In reference to figure 1, by using a personally owned multimedia terminal device

(110), the consumer can connect to a digital contents trade server (300), in charge of trading digital contents, through a wire or wireless communications network at anytime from anywhere.

[50] A digital contents trade server (200) provides to the consumer various information and tools necessary for digital contents trading, and a digital contents trade server (300) is connected to various databases which are contents service means (500).

[51] Contents service means include a digital contents database (DB) server (510) for the purpose of digital contents sales, a consumer DB server (520) for consumer management, and a charge payment DB server (530) for the charging and payment from trade.

[52] Also, on the digital contents trade server (300) a digital contents management means (400), which has the technology to directly manage and reference digital contents to consumer user information or history, is connected.

[53] The digital contents management supervising means (400) includes a DRM server for digital rights management (410), a KMID server (420) related to standard code, a watermark server (430) related to illegal copying prevention technology, and a fingerprint server (440) related to the concept of a fingerprint of public key. The DRM server (410), KMID server (420), watermark server (430), fingerprint server (440), and PKI server (450) are connected to the digital contents trade server (300), so when the consumer trades digital contents, the reciprocal information is always given and

received.

[54] Therefore, the digital contents trade server (300) mediates between the contents service means (500) and the digital contents management supervising means allowing the formation of reselling transaction, direct transaction, mediated transaction, and auction transaction of digital contents.

[55] Therefore, digital contents can be traded directly or indirectly between consumer multimedia terminal device (110) and another consumer multimedia terminal device, consumer multimedia terminal device and business multimedia terminal device (120), or business multimedia terminal device (120) and another business multimedia terminal device by reselling transaction, direct transaction, mediated transaction, and auction transaction methods.

[56] The reselling transaction, direct transaction, mediated transaction, and auction transaction methods of digital contents between consumer multimedia terminal device (110) and another consumer multimedia terminal device are P2P (peer to peer); the reselling transaction, direct transaction, mediated transaction, and auction transaction methods of digital contents between consumer multimedia terminal device (110) and business multimedia terminal device (120) are B2C (business to customer), the reselling transaction, direct transaction, mediated transaction, and auction transaction methods of digital contents between business multimedia terminal device (120) and business multimedia terminal device (120) are B2B (business to business), but not limited to the above methods.

[57] Furthermore, the digital contents purchased by the consumer includes sound, music, still images, or video clips, and all software managed by the digital contents management supervising means (500).

[58]

[59] Figure 2 is the flow chart of the resale transaction process of digital contents under operation of the method of trading digital rights management based digital contents.

[60] In reference to figure 2, the steps of method of reselling digital contents is first, the consumer connects to the digital contents trade server (300) on a wire or wireless network through a personal multimedia terminal device (110) and registers as a member on the digital contents server (300) and the linked reselling transaction site (stage SlOl).

[61] Next, in order to sell the digital contents, the consumer registers the digital contents on the digital contents trade server (300) and the linked reselling transaction site (stage S 102).

[62] Next, the digital contents registered in stage S 102 is evaluated of its validity on the

DRM server (410), KMID server (420), watermark server (430), fingerprint server (440), and PKI server (450) of the digital contents management supervising means

(400) (stage S 103).

[63] Next, the digital contents evaluated for its validity in stage S 103, the proper ownership, based on the information and background on the digital contents DB server (510) and consumer DB server (520), is granted to the registered consumer by the DRM server (410) or PKI server (450) of the contents management supervising means (400) (stage S 104).

[64] Next, when a purchase request is made for the digital contents on the reselling transaction site linked to the digital contents trade server (300), the purchase contract about the utilization condition of the digital contents, such as utilization frequency, utilization term, utilization software, utilization device, utilization subject, utilization place, and utilization method, is made with the purchaser (stage S 105).

[65] Next, the digital contents purchased through the purchase contract is payed for on the charge payment DB server (530) that is linked to the digital contents trade server (300) (stage S 106).

[66] Next, the purchaser is granted utilization rights of the purchased digital contents which was payed for in stage S 106 (stage S 107).

[67] Next, excess digital contents after usage under the contract utilization conditions from stage S 105 are requested for resale through the reselling transaction site that is linked to the digital contents trade server (300) (stage S 108).

[68] Next, the digital contents utilization history of the digital contents requested for resale in stage S 108 is referenced on the consumer DB server (520) that is linked to the digital contents trade server (300) (stage S 109).

[69] Next, based on the referenced utilization history in stage S 109, the remaining utilization rights of the digital contents are analyzed on the contents service means (500) and digital contents management supervising means (400) as well as the reciprocally connected digital contents trade server (300) (stage SI lO).

[70] Next, the if the utilization rights of the analyzed digital contents in stage SI lO are valid, the approval of the resale request in stage S 108 is decided on the digital contents trade server (300) (stage Si l l).

[71] Next, during the determination for resale of digital contents in stage Si l l, the amount of money calculated by a separately appropriated method is sent to the account of the requester, who is also the consumer, or the payment can be made by mileage, points, and items (stage S 112).

[72] Also, it is appropriate to include a stage in which when a resale request is rejected during the approval process of resale requests in stage Si l l, the rejection notification for the digital contents is sent through the digital contents trade server and the linked resale transaction site.

[73]

[74] Figure 3 is a flow chart of the direct transaction process of digital contents under operation of the method of trading digital rights management based digital contents.

[75] In reference to figure 3, the method of direct transaction of digital contents is, first the consumer connects to the digital contents trade server (300) on a wire or wireless communications network through a personal multimedia terminal device (110) and registers as a member on the direct transaction site that is linked to the digital contents trade server (300) (stage S201).

[76] Next, in order to sell the digital contents, the consumer registers the digital contents on the direct transaction site that is linked to the digital contents trade server (300) (stage S202).

[77] Next, the digital contents registered in stage S202 is evaluated of its validity by the

DRM server (410), KMID server (420), Watermark server (430), fingerprint server (440), and PKI server (450) of the digital contents management supervising means (stage S203).

[78] Next, the digital contents evaluated for its validity in stage S203, the proper ownership, based on the information and background on the digital contents DB server (510) and consumer DB server (520), is granted to the registered consumer by the DRM server (410) or PKI server (450) of the contents management supervising means (400) (stage S204).

[79] Next, the digital contents register in stage S202 are referenced for the consumer digital contents utilization history on the consumer DB server (520) that is connected to the digital contents trade server (300) (stage S205).

[80] Next, based on the referenced utilization history in stage S205, the remaining utilization rights of the digital contents are posted on applicable direct transaction site that is linked to the digital contents trade server (300) (stage S206).

[81] Next, through stage S206, a new consumer requests the purchase of the digital contents posted on the applicable direct transaction site (stage S207).

[82] Next, the amount of money calculated by a separately appropriated method is sent to the account of the new consumer who requested the purchase of the digital contents in stage S207, or the payment can be made by mileage, points, or items (stage S208).

[83] Next, once the fee payment through stage S208 is completed, the ownership rights of the digital contents are transferred to the new consumer (stage S209).

[84]

[85] Figure 4 is a flow chart of the mediated transaction process of digital contents under operation of the method of trading digital rights management based digital contents.

[86] In reference to figure 4, the method of mediated transaction of digital contents is, first the consumer connects to the digital contents trade server (300) on a wire or wireless communications network through a personal multimedia terminal device

(110) and registers as a member on the mediated transaction site that is linked to the digital contents trade server (300) (stage S301). [87] Next, in order to sell the digital contents, the consumer registers the digital contents on the mediated transaction site that is linked to the digital contents trade server (300)

(stage S302). [88] Next, the digital contents registered in stage S302 is evaluated of its validity by the

DRM server (410), KMID server (420), Watermark server (430), fingerprint server

(440), and PKI server (450) of the digital contents management supervising means

(stage S303). [89] Next, the digital contents evaluated for its validity in stage S303, the proper ownership, based on the information of the digital contents DB server (510) and consumer DB server (520) of the contents service means (500), is granted to the registered consumer on the DRM server (410) or PKI server (450) of the contents management supervising means (400) (stage S304). [90] Next, the digital contents registered in stage S302 is referenced for the consumer utilization history of the digital contents on the consumer DB server (520) that is connected to the digital contents trade server (300) (stage S305). [91] Next, based on the referenced utilization history, the remaining utilization rights of the digital contents is posted on the applicable mediated transaction site that is linked to the digital contents trade server (300) (stage S306). [92] Next, through stage S306, a new consumer requests the purchase of the digital contents posted on the applicable mediated transaction site (stage S307). [93] Next, the amount of money calculated by a separately appropriated method is sent to the account of the new consumer who requested the purchase of the digital contents in stage S307, or the payment can be made by mileage, points, or items (stage S308). [94] Next, once the fee payment through stage S308 is complete, the ownership rights of the digital contents is transferred to the new consumer (stage S309). [95] Next the mediated service charge payed in stage S308 is distributed on the fee payment DB server (530) to original author of the digital contents who is also the digital contents provider and those closely related, the network business that manages the mediation service, the creator of the contents, and the general consumers who provide to the mediated transaction site (stage S310). [96] [97] Figure 5 is a flow chart of the auction transaction process of digital contents under operation of the method of trading digital rights management based digital contents. [98] In reference to figure 5, the method of auction transaction of digital contents is, first the consumer connects to the digital contents trade server (300) on a wire or wireless communications network through a personal multimedia terminal device (110) and

registers as a member on the auction transaction site that is linked to the digital contents trade server (300) (stage S401).

[99] Next, in order to sell the digital contents, the consumer registers the digital contents on the auction transaction site that is linked to the digital contents trade server (300) (stage S402).

[100] Next, the validity of the digital contents registered in stage 402 are evaluated by the

DRM server (410), KMID serve (420), watermark server (430), fingerprint server (440), and PKI server (450) of the digital contents management supervising means (400) (stage S403).

[101] Next, the proper ownership of the digital contents evaluated for validity in stage

S403 is decided based on the information on the digital contents DB server (510) and consumer DB server (520) of the contents service means (500) and is granted to a registered consumer on the DRM server (410) or PKI server (450) of the contents management supervising means (400) (stage S404).

[102] Next, the digital contents registered in stage S402 are referenced for the consumer utilization history of the digital contents on the consumer DB server (520) that is connected to the digital contents trade server (300) (stage S405).

[103] Next, based on the referenced utilization history, the remaining utilization rights of the digital contents is posted on the auction transaction site that is linked to the digital contents trade server (300) (stage S406).

[104] Next, the details of the digital contents are notified on the auction transaction site to the possible purchasers who wish to purchase the digital contents posted on the applicable auction transaction site in stage S406. When the possible purchasers suggest an appropriate price of the digital contents, the auction applicant awards the digital contents to the possible purchaser who suggests a satisfying condition. Or, if the auction applicant notifies the possible purchasers of the details of the registered digital contents on the auction transaction server (310), the auction transaction server (310) is presented an appropriate price from possible purchasers. This is recorded on the auction transaction ser (310) and notified to the auction applicant, the possible purchaser who presented the appropriate price is awarded the digital contents (stage S407).

[105] Next, the auction fee of the digital contents awarded in stage S407 is calculated and appropriated by a separate method to be sent or made in payment of mileage, points, and items on the charge payment DB server (530) (stage S408).

[106] Next, once the fee payment in stage S408 is complete, the ownership of the digital contents is transferred to the new consumer (stage S409).

[107] Next, after the transfer of ownership is complete in stage S409, the auction fee of the digital contents is calculated and appropriated by a separate method through the

charge payment DB server (530) to be sent or made in payments in the form of mileage, points, and items and is distributed to the original author of the digital contents, who is also the digital contents provider, those closely related, the network business that manages the mediation service, the creator of the contents, and the general consumers who provide to the mediated transaction site (stage S410).

[108] Also, in the instance the actual value of the awarded digital contents and the actual value of the digital contents owned by the purchaser is equal, the digital contents can by exchanged between the two parties, and in the instance the actual value of the awarded digital contents and the actual value of the digital contents owned by the purchaser is not equal, the digital contents owned by the purchaser can be adjusted in amount to match the value of the awarded digital contents for the exchange of digital contents, taking the place of fee payment of the awarded digital contents.

[109]

[110] Figure 6 is an organization chart of the auction transaction process of digital contents under operation of the method of trading digital rights management based digital contents

[111] In reference to figure 6, the P2P exchange process of digital contents in the transaction of digital contents between a seller and purchaser will be explained more in detail.

[112] First, in the auction transaction, when the auction applicant, who is also the seller, does not want exercise utilization rights of previously purchased digital contents anymore, after deciding the utilization possibility of the digital contents, the digital contents is registered on the applicable auction transaction site that is linked to the auction transaction server (310).

[113] Next, when wanting to purchase the registered digital contents, the details are notified to the possible purchasers on the auction transaction site that is linked to the auction transaction server (310), and the possible purchasers present an appropriate price and the purchaser who satisfies the conditions (in the instance of general auctions, the highest bid) is awarded the contents.

[114] Next, the purchaser pays the award fees on the charge payment DB server (530), and after the fee payment of the digital contents based on the approval decision, the seller, who is the auction applicant, and possible purchaser exchanges the contents by method of P2P.

[115] Next, when the exchange of contents is completed, the charge payment DB server

(530) is notified of this and the purchaser pays the necessary amount excluding the contents utilization fee to the auction applicant.

[116] Next, the above fees are distributed equally amongst the digital contents creator as well as provider, copyright holder, those closely related, and the network business that

provides the service. [117] Next, by characteristic of the digital contents, it may be reused, and though it can be used for a specified time, as long as the remaining utilization rights allows, it can be used continuously, maintaining the continuous redistribution of fees. [118] [119] Figure 7 is an organization chart of another method of auction trading process of digital contents under operation of the method of trading digital rights management based digital contents. [120] In reference to figure 7, the process of transferring authority of digital contents relying on the auction server in the exchange between a seller and purchaser will be explained in more detail. [121] First, the seller confirms the utilization possible DRM of the digital contents to cede, and personally registers and sends all of the digital contents to the auction transaction server (310). [122] Next, this is notified on the auction transaction site that is linked to the digital contents auction transaction server, and receives suggestions of appropriate prices of the contents from possible purchasers, records this on the auction transaction server

(310), and posts the digital contents on the auction transaction server (310). [123] Next, when the digital contents is awarded at the appropriate price to the purchaser, the purchaser pays for it and is granted the digital contents as well as the digital contents rights from the auction transaction server (310). [124] Next, the digital contents rights can be transferred freely even without direct contact between the seller and purchaser. [125] Next, the digital contents details are posted on the auction transaction site (310) to the possible purchasers who wish to purchase the digital contents, and possible purchasers suggest an appropriate price, and the purchaser who satisfies the condition

(in the instance of a general auction, the highest bid) is awarded to contents. [126] Next, the purchaser pays the award fee to the charge payment DB server (530), and once the fee of the digital contents is payed, based on the approval decision, the auction applicant and possible purchaser exchanges the digital contents by method of

B2C. [127] Next, once the exchange of the contents is completed, the charge payment DB server is notified of this and the necessary amount payed by the consumer excluding the utilization fee is payed to the auction applicant who is also the seller. [128] Next, the above fees are distributed equally amongst digital contents creator and provider, the copyright owner, those closely related, and the network business that provides the service.. [129] Next, by characteristic of the digital contents, it may be reused, and though it can be

used for a specified time, as long as the remaining utilization rights allows, it can be used continuously, maintaining the continuous redistribution of fees.

[130] Also, in the instance the actual value of the awarded digital contents and the actual value of the digital contents owned by the purchaser is equal, the digital contents can by exchanged between the two parties, and in the instance the actual value of the awarded digital contents and the actual value of the digital contents owned by the purchaser is not equal, the digital contents owned by the purchaser can be adjusted in amount to match the value of the awarded digital contents for the exchange of digital contents, taking the place of fee payment of the awarded digital contents.

[131] Also, on the condition the advertiser combines the provided advertisement or publicity material to digital contents in the form of digital files and make into DRM to provide to possible purchasers, the advertiser distributes fixed payment or profit according to contribution or its rate by the whole traffic amount or the contribution measurement after totaling the page view, downloads, or ratings to at least one of the following: middleman, legal copyright holder, owner, resale right holder, digital contents seller, and contents provider. The possible purchaser, who purchases digital contents made into DRM by combining advertisement or publicity material in digital file form, is provided and uses digital contents or money at a free or discounted price instead of auction award fees on condition. The condition is that after the possible purchaser purchases the digital contents made into DRM by combining advertisement or publicity material into digital file form, the digital contents are set to open in the instance exclusive SW (software) is used or location base (LBS) is used in a certain region, or the advertisement is seen at a fixed time for a fixed number of times instead as a characteristic of the method of trading digital rights management based digital contents.

[132] Also, the method of trading digital rights management based digital contents is not limited by utilization of exclusive SW (software) such as firmware/embedded SW/VM on the terminal device or transaction on other sites after plug-in method.

[133]

[134] This invention is not limited to the above explanations of operation, and who ever has the general knowledge of the technology of this invention without deviating from the purpose of the claim ranges can operate change, and these changes are added to the claim ranges statement limits.
