Disclosed are a top cover opening and closing apparatus, applied to a wagon body and comprising: a top cover (1) provided on the wagon body (2) and comprising a first cover body (11) and a second cover body (12); a rotating member (3) comprising a first rotating member (31) and a second rotating member (32), the second rotating member (32) being connected between the wagon body (2) and the second cover body (12); a linkage apparatus (4) provided on the wagon body (2) and connected between the first rotating member (31) and the second rotating member (32); a driving apparatus (5); and an elastic connecting member (6), acting ends of the elastic connecting member (6) being drivingly connected to the first rotating member (31) and the second rotating member (32), respectively. Embodiments of the present disclosure further provides a railway wagon, comprising the top cover opening and closing apparatus.
