To provide an imaging device and an imaging method for capturing an image without missing a chance to capture images including a face deformed by a special scene or environment, which is unlikely to be caused by a change of facial expression.

A face image is detected from an image captured by an imaging part 3 via a face detecting part 4a. A feature amount detecting part 4b detects feature quantity having a shade whose amount of change by facial expression is small. A deformation determination part 4d determines whether the detected feature quantity has exceeded the amount of change of the facial expression, and the image is recorded in a recording part 8 when it is deformed in excess of the predetermined level.
