An optical element 1 for reflecting a part of incident light and transmitting a part thereof comprises: a diffraction function layer 4 for diffracting at least a part of the incident light; and a grid 2 formed on one face of the diffraction function layer 4 and comprising a polarization separation function that comprises a plurality of fine wires. The one face of the diffraction function layer 4 comprises: a plurality of first regions 4a; and a plurality of second regions 4b different from the first regions 4a in height from the other face 4c of the diffraction function layer 4. In addition, the optical element comprises a step part 8 in a boundary of the first region 4a and the second region 4b.
