To provide a variable capacity type compressor capable of preventing the pressure of a crank case from being excessively increased.

A capacity control valve 46 adjusts the introducing amount of discharge refrigerating gas high in pressure to a crank case 15 by letting the opening of a valve port 53 be adjusted by means of a valve element 52, and a discharge capacity is adjusted by changing the pressure of the crank case 15. The adjustment of the opening of the valve port 53 by means of the valve element 52 allows a solenoid rod 63 to be slid so as to be moved with respect to a stationary iron core 60. Therefore, a pressure acting part 91 integrally formed with the solenoid rod 63 changes a volume ratio between two pressure acting chambers 90a and 90b so as to let oil 'O' to be positively communicated with both the chambers 90a and 90b by way of a communicating path 93. As a result, the communication resistance of oil 'O' through a communication path 92 small in a passing through cross section, is given to the solenoid rod 63 as moving resistance. This constitution thereby allows the valve element 52 to gradually open the valve port 53 entirely at the time of suspending a compressor, and of starting a cut-out in acceleration, so that the pressure of the crank case will never be quickly increased.
