Disclosed are a congestion control method, device and apparatus, which are used for solving the problem in the prior art of an access control and mobility management function network element or a session management function network element being overloaded. The method comprises: a UE sending an indication of supporting the capability of a control plane data backoff timer to an access and mobility management function network element or a session management function network element; the UE receiving duration information, indicated by the access and mobility management function network element or the session management function network element, of the control plane data backoff timer, wherein the control plane data backoff timer is set for the UE by the access and mobility management function network element or the session management function network element when the access and mobility management function network element or the session management function network element is overloaded; and the UE starting the control plane data backoff timer and not transmitting data through the control plane until the control plane data backoff timer expires.
