Provided is an encoding device configured to divide, into blocks, each of original images provided in units of frames constituting a moving image and to encode the blocks, the encoding device comprising: a list generating unit configured to generate a list including motion vector candidates for a block to be encoded on the basis of a division shape of the block to be encoded and a division shape and a motion vector of an adjacent block adjacent to the block to be encoded; and an encoding unit configured to encode a motion vector of the block to be encoded on the basis of the list. The list generating unit is configured to avoid adding a motion vector of an adjacent same-layer block that is a same-layer block adjacent to the block to be encoded if the block to be encoded and the adjacent same-layer block can be integrated together. The same-layer block has the same width and height as those of the block to be encoded and was present, before the last division, in the same block as the block to be encoded.
