To provide a solid polymer type fuel cell capable of suppressing reduction of performance further when fuel is insufficient such as the time of high electric potential operation.
This solid polymer type fuel cell is constituted by stacking a plurality of units constituted by laminating an anode diffusion layer, an anode catalyst layer, a polymer electrolyte film, a cathode catalyst layer, and a cathode diffusion layer sequentially. The anode diffusion layer is provided with a layer composed of carbon particle carrying platinum/ruthenium catalyst, polymer electrolyte, and a hole making material on a face in contact with an anode electrode layer. Ion exchange capacity of the polymer electrolyte film is 1.5 meq/g or more.
