PROBLEM TO BE SOLVED: To provide an encoding device and an encoding method that can reduce a deterioration in image quality due to encoding.SOLUTION: An image processing apparatus comprises: a luminance information acquisition part 201 that acquires luminance information on the basis of pixel values of a plurality of pixels forming an image; a block size limitation part 202 that creates, on the basis of the luminance information, block size limitation information on the upper limit of a block size of a block including a plurality of pixels; and an encoding processing part 114 that performs encoding of an image with the block set on the basis of the block size limitation information as a unit.SELECTED DRAWING: Figure 2
