PROBLEM TO BE SOLVED: To provide a light emission element having a novel structure that can control the brightness, directivity or polarization characteristic of a light emission element using photoluminescence material, and a light emission device having the same.SOLUTION: A light emission element 100 has a photoluminescence layer 110, a light transmissible layer 120, and a submicron structure spreading within the plane of the photoluminescence layer 110 or the light transmissible layer 120. The submicron structure contains at least two periodical structures. Light emitted from the photoluminescence layer contains first light having a wavelength of λin the air and second light having a wavelength of λin the air. When the reflectivities of the photoluminescence layer to the first light and the second light are represented by nandrespectively, the first period is represented by pand the second period is represented by p, the at least two periodic structures contain a first periodic structure satisfying the relationship of λ/n
