To protect a copyright of audio data to be recorded on a recording medium.
A current MD is initialized by following procedures. First of all, it is confirmed whether or not a UID is recorded on the disk and next, a U-TOC is recorded with EFM modulation. An alert track and a FAT is secured by the U-TOC. Next, the alert track is recorded with EFM modulation. Next, a DDT is recorded with 1-7 modulation. When the UID is not recorded on the disk beforehand, the UID which is unique information is newly generated and recorded. Then, the FAT is recorded with 1-7 modulation. The UID is recorded in an area out of FAT management, such that the UID is utilized for copyright protection. The UID is recorded based upon the decision of whether or not the UID is recorded in advance, such that the current MD on which the UID is not recorded is available.
