The present invention relates to the technical field of oil-based drilling fluids, in particular to a composition of a maleated fatty acid and a derivative thereof and an oil-based drilling fluid. The composition comprises: effective components and a solvent , wherein the effective components comprise a maleated fatty acid, maleated fatty-based imidazoline amide and maleated fatty acid alkanolamide, and the solvent comprises a mixture of solvent oil and alcohol ether. The composition of the maleated fatty acid and the derivative thereof provided by the present invention is used as an emulsifier, after hot rolling at 240°C, the emulsification rate is 85%, the wetting rate is 94%, the demulsification voltage of the oil-based drilling fluid is 570 V, and both emulsifying and wetting effects are achieved.
