Description:
UNDERWEAR FOR DISPENSING THERAPEUTIC SUBSTANCES

Cross-Reference to Related Applications

This application claims the benefit of United States Provisional patent application no. 63/068,813 and Canadian patent application no. 3,090,721, both of which were filed on August 21, 2020 and both entitled "UnderwearforDispensingCBD", and both of these prior patent applications are incorporated herein by reference.

Field

This application re lates to arti cl esfor applying topical therapeutic substances to skin; in particular, this application relates to articles for applying topical therapeutic substances to skin located in the user's pelvic, pubic, genital, perineum, and/or anal areas and the like.

Background

The topical application of different substances, including but not limited to vitamins, oils, hormones and drugs, to the human skin for treatment of different types of health issues, or for the enhancement of the human skin, is known in the art. However, there are particular chal lenges posed by the application of such substances, herein after referred to as "therapeutic substances,"toa person's genital, pelvic, pubic, perineum and/or anal areas. Firstly, becausesuch therapeutic substances are often in a liquid form, it is challeng ing to keep the therapeutic substances on the desired areas of one's skin without having the therapeutic substance absorb through the person's undergarments and, potentially, leak through the person's outer clothing, such as pants or a skirt. Should such therapeutic substances leak through a person's outer clothing, this may cause unsightly stains on the outer clothing. Furthermore, the absorption of the therapeutic substances into the person's clothing draws the therapeutic substances away from the targeted skin area, potentially reducingthe effectiveness of the desired treatment.

Additionally, simply applying such therapeutic substances, in liquid form, to a person's genital, pelvic, pubic per ineum and/or anal areas may cause discomfort as the person engages in dai ly activities, because such application may cause the person to feel a wet and unpleasant sensation in the areas where the therapeutic substance has been applied. As well, if effective therapeutic treatment of the person's skin requires consistent contact of the therapeutic substance on the person's skin, it may be difficult for the person to constantly re-apply fresh coatings of the therapeutic substance to their genital, pelvic, pubic, perineum and/or anal areas as the person engages in their daily activities, as such re-application may require the person to seek out a private location to engage in the re-application, away from public view.

In the prior art, of which the applicants are aware, in United States patent application no. 16/994,081 by inventor Blasius, there is disclosed an absorbent article includ ing a center portion for absorb ing fluid. The center portion, side portion, adhesive portion or any combinations thereof comprise hemp. The absorbent article may also include a water-dispersible and/or biodegradable polymer or a biopolymer; examples of biopolymers may include hemp, sugar cane, microorganisms, cel lulose, starch, and any other polymeric material including polylactic acid, polyhydroxyalkanoate, polybutylene succinate, polyhydroxybutyrate, and polybutylene terephthalate. Natural oils may be extracted from a plant and applied to the absorbent article to alleviate or relieve pains, aches, cramps related to menstruation, includingoil produced or extracted from the plant Cannabis sativa. Additionally, the absorbent article may be coated or infused with cannab inoids, including cannabi diol ("CBD"), extracted from a Cannabis plant. The CBD oil may be applied to a surface of each layer of the plurality of layers of the absorbent article, orthe CBD oil may be infused between the plurality of layers of the absorbent article.

In United States patent no. 10,765,848 to Dimino et al., a device for the topical treatment of pain affecting the vulvar area of the female human genital organ is disclosed. The device is a layered article shaped to be placed in a female undergarment and at least partially in contact with the skin of the female vulvararea, the device comprising a topical formulation. The device comprises a formulation- impermeable outer layer, a carrier layer not adhered to the outer layer in an area def ined by a channel of a rim layer, leaving a void space betweenthe two layers and thereby forming a channel into which a topical formulation may be released and distributed therein. A dispensing unit may be placed adjacent the channel, the dispensing unit comprising a pouch that will rupture when pressure is applied to the pouch by the user, and release the formulation contained in the pouch into the channel. The formulation released by the dispensing unit into the channel is absorbed into the carrier layer and transported to the skin-contacting surface of the carrier layer and thereby administered to the treatment area of the user. In the international publication no. WO 2020/026209 by applicant Anne's Day Limited, a catamenial tampon for absorb ing menstrual flow and for treating menstrual symptoms is disclosed. The tampon has an absorbent tampon body made of industrial hemp fiber. The tampon body is provided with a pharmaceutical composition comprising an effective amount of cannabidiol for treatment of symptoms associated with menstruation.

In United States patent application no. 15/012,045 by applicant Axim Biotechnologies, Inc., a sugar alcohol and cannabinoid complex is disclosed, as well as methods to prepare the complex from cannab inoid oil comprising at least one cannabinoid. The complex is in asolid form, and may be used in food, pharmaceutical, cosmeticformulations, and medical devices wherein solid forms of cannabinoid are desirable.

Summary

Presently disclosed herein is an article for the metered dispens ing of therapeutic substances to a person's skin, located particularly in the pelvic, pubic, genital, per ineum and/or anal areas of the person, for the topical treatment via the person's skin in those areas. In one aspect, the treatment is administered by a disposable undergarment, such as a disposable all-in-one thong, which incorporates an effective amount of a therapeutic substance, such as cannabidiol ("CBD") oil, suspended in asolid oil .

The article may have a sandwich construction comprising of several layers. In some embodiments, the layersinclude afluid permeabletop sheet positioned adjacent the user's skin when the article is worn by the user; an absorbent polymer layer for absorption of the user's bodily fluids, and atherapeutic substance layer sandwiched between the absorbent polymer layer and the top sheet. When the person's bodily fluids pass through the top sheet and the therapeutic substance layer into the absorbent polymer layer, the absorbent polymer layer absorbs the person's bodily fluids, which causes the absorbent polymer layer to swell and expand. As the absorbent polymer layer swel ls and expands, the absorbent polymer layer thereby propels the therapeutic substances contained in the therapeutic substance layer through the top sheet and into contact with the user's skin that is adjacent the top sheet of the article.

In another aspect, the therapeutic substances contained in the therapeutic substance layer may include compositions comprising a solid oil, the solid oil having a solid phase at room temperature and a liquid phase at skin surface temperature. The composition may also include one or more therapeutic substances combined with or suspended in the solid oil. When the solid oil is brought in proximity to the user's skin, the temperature of the solid oil increases and causes the solid oil to melt into a liquid phase, which enables the liquid phase to be propelled by the swol len and expanded absorbent polymer layer through the top sheet and into contact with the skin of the user adjacent the top sheet.

In some embodiments, the therapeutic substances include CBD oil. The therapeutic substances may also include, but are not limited to, vitamins, othertypes of oils, emollients, hormones, drugs, plant extracts, microorganisms and the like.

In one aspect of the present disclosure, a delivery article for the metered delivery of a therapeutic substance toa user'sskin, particularly in the user's pelvic, pubic, genital, perineum, anal areas and the like, comprises a layered sandwich construction, the sandwich construction coveringone or more of the said areas of the user when the article is worn by the user. For males, the application of CBD oil to the genital area may also have therapeutic benefits, including but not limited to aiding in healing after a vasectomy. Forboth malesandfemales, the application of CBD oil to the genital, pelvic. pubic, perineum and/or anal areas may also assist in treatment of eczema, rashes caused by urinary incontinence or excessive perspiration, and may be useful in the treatment of rashes caused by a fungal infection, such as jock itch or ringworm. Furthermore, the application of CBD oil to the genital area may be advantageous while travelling or partaking in sports.

Referring to FIGS. 1A to 1G, one illustrated embodiment of the article includes an all-in-one disposable thong garment 100. Thong 100 includes an elasticized waistband 102, a back sheet layer 104 and a top sheet layer 106, the back and top sheet layers 104, 106 together encasing a layered sandwich construction of multi ple layers including the therapeutic substance layer, as will be further described below. The elasticized waistband 102 may include one or more fasteners 108, which may for example include hook and loop fasteners, such as Velcro™.

The top sheet layer 106 is a fluid permeable top sheet that is positioned against the skin of the user when the thong garment 100 is worn. A crotch portion 106c of the fluid permeable top sheet layer 106 encases the absorbent and therapeutic substance layers of the thong 100, which layers are il lustrated in FIGS. IB to 1G. Adjacent the crotch portion 106c of the top sheet layer is a rear portion 106a extending towards and attached to the waistband 102 at the rear si de of the thong 100, and simi larly an adjacent front portion 106b of the top sheet layer extends towards and attached to the waistband 102 at the front side of the thong 100. The fluid permeable top sheet 106 may be of a non-woven material and allows bodi ly fluids to pass through the top sheet. The bodily fluids may be filtered by the top sheet 106. In some embodiments, the top sheet 106 may be embossed with a pattern, which may be aesthetically pleas ing, and may also serve to provide channels orgrooves for receiving and directing bodily fluids of the user. The top sheet layer 106 may also be printed with a pattern.

Directly beneath the top sheet layer 106 is a therapeutic substance layer 114. The therapeutic substance Iayer ll4 may include a composition of therapeutic substances, including but not limited to CBD oil, as well asothertherapeutic substancesthat are described elsewhere in the present disclosure. Thetherapeutic substances may be suspended in one or more solid oils, which are oils that are in a solid phase at room temperature, for example in the range of 20“C to 23°C, and which transition to a liquid phase at body temperature, for example in the range of 34.7°C to 38°C. Advantageously, the composition may contain specific amounts of one or more therapeutic substances in specific concentrations and in combination with one or more solid oils, so as toform pellets or a coating 114a, thereby creating a layer underneath the top sheet of the sandwich construction. The composition, in the form of a solid oil mixture, may be carried on a substrate 114b, such as a woven or non-woven material . In some aspects, the solid oil mixture may be placed into the therapeutic substance Iayer 114 at vary ing depths, using an accurate dose, automated liquid injecting dispensing system. The solid oil mixture may be contained in a strip along a center line of the therapeutic substance layer 114, or in other embodiments the solid oil mixture may cover a portion of or the entire area of the therapeutic substance layer 114.

Prior to use of the article, the solid oil mixture or composition re mains in the solid phase. During use of the article, as the solid oil composition 114a is positioned proxi mate the body of the user, thereby transferring the user's body heat to the solid oil composition 114a so as to melt the solid oil composition 114a into a liquid phase. The transfer of the user's body heat may occur by a combination of transfer from the user's skin and/or any bodily fluids discharged by the user, which bodily fluids passthrough the top sheet 106and into the therapeutic substance Iayer ll4.

Beneath the therapeutic substance layer 114 is an absorbent polymer layer 116, containing an absorbent polymer 116a. Preferably, the absorbent polymer 116a is a super absorbent polymer ("SAP"), which may be comprised of, for example, sodium polyacrylate. SAPsare materials which are capable of absorb ing up to 300 times their weight in aqueous fluids, and which do not release the aqueous fluids once absorbed. Due to this ability to absorb and contain a relatively large amount of aqueous fluids, which include bodily fluids, the SAPs swell and expand in volume upon absorbing aqueous fluids. In some embodiments, the absorbent polymer layer 116 may optionally include other absorbent materials, such as but not limited to pump, cotton, hemp and/or other absorbent fibers, to provide additional absorbency tothe absorbent polymer layer 116.

In some embodiments, the sandwich construction may optionally also include a hydrophobic back sheet 118. The hydrophobic back sheet 118 serves to repel the bodi ly fluids that filter through the top sheet 106 and preventthe passage of those fluids through the article 100. Additionally, some embodiments may optionally include a removable protective film layer 120, which layer 120 may be attached to the top sheet layer 106 by means of an adhesive. The protective film layer 120 serves to protect the disposable thong 100 from moisture or contaminants prior to use and to assist in conta ining the therapeutic substanceswithin the article. Therefore, the removable protective film layer l20 may be a hydrophobicsubstance such as a plasticfi lm ora wax coated paper. The I aye red sandwich construction, including the therapeutic substance layer 114, absorbent polymer layer 116 and the optional hydrophobic back sheet layer 118 may be encased by the top sheet layer 106c and the back sheet layer 104, as best viewed in FIG. 1B. It wil l also be appreciated that the back sheet layer 104 may be hydrophobic, in which case the hydrophobic back sheet layer 118 may not be included.

To use the disposable thong 100, if the disposable thong includes the optional protective film 120, the user removes the protective fi lm 120from the top sheet 112 before wearingthe thong 100. Once the user puts on the thong 100, the top sheet 106 is positioned snugly against the user's pubicand genital areas. As the user wears the thong 100 for a period of time, any bodily fluids of the user will be captured by and filter through the fluid permeable top sheet 106 as the fluids are pul led downwardly through the top sheet by gravity. The user's body heat, radiating from the skin of the user and from the user's bodily fluids, will transfer to the solid oil composition 114a of the therapeutic substance layer 114, thereby transitioning the solid oil composition 114a from the solid phase to the liquid phase. The bodily fluids released by the user wi ll pass through the therapeutic substance layer 114 to the absorbent polymer layer 116, where the bodily fluid will be absorbed by the absorbent polymer 116a, which may include SAP. Any excess bodi ly fluid that initially passes through the absorbent polymer layer wi ll be repelled by the hydrophobic back sheet 118, in embodiments that include a hydrophobic back sheet 118, and may also be thereby absorbed by the absorbent polymer layer 116. As the absorbent polymer orSAP 116a absorbs the bodilyfluid, it wil l swell and expand in volume, thereby push ing upwardly on the therapeutic substance layer 114. As a result, the swelling absorbent polymer layer 116 propels the solid oil composition 114a, containing the therapeutic substances, towards and through the top sheet 106, as the solid oil composition 114a has melted intothe liquid phase, therebyfacilitatingthe transport of the solid oil composition 114a through the fluid permeable top sheet layer 106. The solid oil composition 114a thereby comes into contact with the user's skin that is adjacent the top sheet layer 106, accomplish ing the topical application of the therapeutic substance contained in the solid oil composition to the user's skin intheirgenital and pelvic areas.

In some embodiments, the top sheet 106 may include perforations for controlling the flow of the therapeutic substancesthat passesthrough the top sheet layer 106 to come into contact with the user.
