Encoding processing parts 120, 121, and 122 encode a macro block which is not in contact with an area boundary by a first encoding mode of encoding using information of a macro block adjacent to the macro block. The encoding processing parts 120, 121, and 122 encode a macro block which is in contact with an area boundary by a second encoding mode of encoding using information of only the macro block or information of a macro block which exists within an area the macro block belongs to and which is adjacent to the macro block.
